California's initial self-driving trucks are now operational, and the regulations governing them are being debated in court.

California has granted its first permits for testing autonomous trucks on public roads to Aurora Innovation and Kodiak AI, with Kodiak already operating some vehicles near Mountain View. On August 5, Teamsters California filed a lawsuit seeking a court order to overturn the regulations that enabled the permits.

This marks the first instance of self-driving trucks being tested on public roads in California. The state's Department of Motor Vehicles has issued permits to both Aurora Innovation and Kodiak AI, with Kodiak beginning to utilize several trucks, primarily around its Mountain View location. This action follows a regulatory change on April 28 that lifted California's prohibition on testing autonomous vehicles over 10,000 pounds, which had kept both companies from operating in their home state for several years.

The permits come with strict conditions. A safety driver is required to remain at the wheel, and testing is prohibited on roads with speed limits of 25 mph or less, unless the truck is taking a direct route to its destination.

These regulations are currently being contested. Teamsters California submitted a writ petition to Alameda Superior Court on August 5, just days before the permits were issued, requesting a judge to annul the regulations.

The union’s case focuses on procedural issues rather than technology. They contend that the DMV neglected to fulfill requirements to study and disclose the economic impact of permitting driverless heavy trucks and did not adequately consider the safety risks to other road users. "Such a critical decision with life-and-death consequences must involve public input and transparency," stated Peter Finn, co-chair of Teamsters California. "That is why Teamsters California is taking the DMV to court."

The union is not solely depending on legal action. Co-chair Victor Mineros mentioned that they would continue to fight "in the courtroom, at the ballot box, and into the next administration," and gubernatorial candidate Xavier Becerra has vowed to overturn the DMV regulations if he wins.

This situation arises from a regulatory decision instead of legislative action. In 2023, California lawmakers enacted a bill mandating human operators in autonomous trucks, which Governor Gavin Newsom subsequently vetoed, allowing the DMV to establish the rules.

During the wait, both companies have operated in Texas. Aurora began driverless freight operations there in May 2025, covering routes such as Fort Worth to El Paso and Laredo to Dallas, while Kodiak commenced in January 2025. Both firms adapted their hardware and software for production semi-trucks instead of developing vehicles without cabs from the ground up.

This trend is becoming increasingly common across the industry, which continues to advance more rapidly than the debates surrounding it can be resolved.
