Discord and Meta are being sued as product entities rather than as publishers.

      The complaint explicitly states what many similar cases only hint at. Its authors assert that it aims to confront how Discord and Meta exploit “section 230 of the Communications Decency Act as a shield against accountability.” This single statement summarizes the entire filing.

      A California woman, referred to as Jane Doe, submitted the complaint in San Francisco Superior Court on April 16. Business Insider was the first to report on the case, which consists of a 57-page document identifying Discord and Meta and outlining six causes of action. None of these claims pertain to defamation, publication, or any assertions related to content.

      The significance of the causes of action outweighs the headline. Section 230 provides immunity to platforms against liability for user-generated content, preventing most cases like this from proceeding for two decades. Thus, the complaint does not target the abusive content posted by users; instead, it holds the companies accountable for how they developed the software.

      Two of the claims focus on product liability, citing design defects and a failure to warn, while three others allege negligence in operation, design, and warning. The sixth claim references California’s Unfair Competition Law. This legal terminology typically used for a defective car is applied here to a chat application.

      The distinction is crucial to the overall strategy. Section 230 protects both companies if the harm arises from third-party content, but it may not cover damage resulting from the companies’ design decisions.

      The filing specifies particular features and categorizes them as defects. Against Discord, three features are highlighted: anonymity, the ability for minors to engage in voice and video calls, and screen sharing. According to the complaint, these features provide predators with “multiple avenues to manipulate, coerce, and exploit children in real time.” It claims Discord has declined to implement mandatory age and identity verification and has not enacted technical rules to prevent adults from privately messaging minors.

      The sharpest allegation in the complaint states that Discord rejected these measures because they “would impede user growth and frictionless onboarding of new users.” The complaint also criticizes Discord’s Family Center, which is marketed to parents, arguing that it is optional and conceals message content from them.

      In terms of Meta, the complaint claims that the company designed Instagram without “age gates.” It asserts that hashtags, search functions, and algorithmic recommendations grouped children together, making them accessible to adults.

      The allegations detailed in the complaint are serious, and the narrative intentionally keeps them brief. The plaintiff recounts that at 15, a member of a group called Greggy’s Cult contacted her via a public Discord server and coerced her into creating sexual images. At 17, after she discussed her mental health on Instagram, a member of a group called CVLT reached out, building trust over several months before obtaining her home address and threatening her. She claims he coerced her into creating more images and self-harm, threatening her family and pets. At 18, a third group, 764, recruited her, and she escaped by faking her own death.

      The individuals involved are not fictional. Zachary Dosch pleaded guilty in 2023 to distributing child sexual abuse materials and was charged again in 2025 alongside four others for extorting children, to which he pleaded not guilty. Collin John Thomas Walker pleaded guilty to charges of child exploitation in October 2025. The FBI regards this situation as more than ordinary online crime; its Boston office has raised alarms about “nihilistic violent extremists” targeting children and is investigating over 450 individuals nationwide, classifying the actions as domestic terrorism. Most of the suspects are male, in their late teens or early twenties, while the majority of victims are teenage girls.

      Neither company has commented on the specific case. Discord stated that dismantling the 764 group is a top priority and that it has been actively addressing the issue since 2021, cooperating closely with law enforcement. The platform has removed thousands of servers and banned hundreds of thousands of accounts associated with the group.

      Meta emphasized its ban on CVLT across its platforms and its strict policies against child exploitation and self-harm content. It reported that specialized teams, including former law enforcement officers and prosecutors, collaborate with the FBI and that a 24/7 response team manages urgent cases.

      Their legal strategies differ significantly. Discord seeks to have the case dismissed entirely based on Section 230, while Meta seeks to merge this case with ongoing litigation concerning social media addiction. This latter set of cases is where Meta recently avoided a second trial and is now facing a seven-week jury trial in Tennessee.

      This case deserves attention because the approach addressing design defects is not novel, but it is inching closer to success.
