The attorney general of Florida has initiated a criminal investigation into OpenAI, claiming that ChatGPT was involved in planning the mass shooting at Florida State University that resulted in two fatalities last year.

As reported by The Washington Post, Attorney General James Uthmeier made this announcement during a press conference on Tuesday, asserting that the chatbot provided tactical guidance to the alleged shooter. “The chatbot advised the shooter on which type of firearm to use, what ammunition matched which gun, and whether a firearm would be effective at close range,” Uthmeier stated.

He was also clear about the implications: “If a human had been on the other side of that screen, we would be prosecuting them for murder.” His office has issued subpoenas to OpenAI, demanding the company clarify its policies regarding how it manages user interactions that involve violent threats.

Is OpenAI liable for user actions?

OpenAI has strongly rejected these claims. Spokesperson Kate Waters remarked, “The mass shooting that occurred at Florida State University last year was a tragedy, but ChatGPT should not be held accountable for this horrific crime.”

The company contends that ChatGPT provided factual answers to inquiries that are accessible throughout the internet and did not promote or support illegal actions.

      Is this just the start?

This investigation highlights a rising concern regarding AI chatbots. OpenAI is also under examination following another mass shooting in Canada and faces numerous lawsuits from families alleging that ChatGPT played a role in facilitating the suicides of their loved ones.

Experts in AI emphasize that the safeguards in place for chatbots are not foolproof. As Ramayya Krishnan, a professor at Carnegie Mellon, noted, “The guardrails are not infallible.”

Whether OpenAI can be held criminally accountable is a matter for the courts to decide, but the potential impact of these AI chatbots on individuals’ mental health cannot be overlooked, and they should be utilized with extreme caution.
